TARRYTOWN, N.Y. Tarrytown trustees hope the third time is a charm.
The village board will once again call a public hearing on its tattoo parlor law in an attempt to further explicate the definition of a school. The hearing is set for Jan. 3 at 8 p.m. at Village Hall.
Trustees had originally amended the law to say that it did not apply to schools with students over the age of 18. The public hearing will consider amending the law to the definition of a school included in the New York State Public Health Law: the term 'school' means and includes any public, private or parochial child caring center, day nursery, day care agency, nursery school, kindergarten, elementary, intermediate or secondary school.
I thought its the best definition I've heard so far, Trustee Douglas Zollo said. I think that was the intent and the school of esthetics does not fit into that definition.
The hearing comes after a few local residents expressed their disapproval of the chosen location for a new tattoo parlor named The Mighty Horseman. Owner Chuk Hognell wants to open his new shop on Neperan Road east of Main St.
Residents took issue with the fact that the location was within 500 feet of The New York School of Esthetics and Day Spa and Yoo's Martial Arts. They argued Yoo's served young children as a school for martial arts and the esthetics school allows students as young as 17.
Some trustees were concerned by the number of amendments to the tattoo parlor law.
How many times are you going to change this law? Until it fits everybody's needs? That's ridiculous, Trustee Robert Hoyt said.
Village Attorney Jeffrey Shumejda said it wasn't necessary to change the law, but the New York State Department of Public Health definition was clear.
At least it's clear, and it doesn't use the term age or refer to age at all, he said.
