NORTH PASSAIC, N.J. -- A Passaic County judge has ruled voters will have not have the chance to decide whether the state should offer a survey about abolishing county government during this fall's election due to a challenge in court, according to NorthJersey.com

Although the Borough Council voted in favor of including the non-binding referendum question on the Nov. 3 ballot, the judge said the challenge could not go forward due to the pending legal challenge, NorthJersey.com said.

Mayor Dan Mahler said the conversation regarding the referendum question is far from over, adding the Passaic County Democratic Committee challenged a similar case and won in court, added NorthJersey.com.

Borough Attorney Anthony Fiorello said the court ruled the referendum was not enforceable and could not be placed on the ballot, said NorthJersey.com.
