Police received a call shortly after 12 a.m., Tuesday that a pickup truck was being operated in an erratic manner on College Road .
Police stopped the vehicle on Route 59, and an officer determined the operator, a 32-year-old Suffern man was drunk and there was an adult female and three-month-old child in the front seat and the child was in an incorrect restraint device, which was not secured properly.
The officer arrested the driver, who was charged with two counts of aggravated driving while intoxicated and one count of driving while intoxicated.
Leandra's Law makes it an automatic felony on the first offense to drive drunk with a person age 15 or younger inside the vehicle.
He was taken to Ramapo Police Headquarters and held for arraignment.
Child Protective Services was also contacted in regards to the endangerment of the infant.
