The city's argument? That the almost six acres of land being contested are not park of the park, according to Town Attorney Michael Klein, said lohud.com.

The court document lists 19 people as petitioners, who maintain that the property was donated to the town for the purpose of providing open space, lohud.com said.

The developer said he plans to build three or four homes on the property, added lohud.com.
