The village issued violations ordering the developers of Park View Condominiums to remove religious baths and a synagogue at the Main Street and Maple Avenue property, saying they lack the proper permits, weren’t included in the project’s site plan and are illegal because federal funding used to build it means religious facilities are not allowed there, lohud.com reported.
Park View has also come under fire from the National Association for the Advancement of Colored People (NAACP), which accused it of not being advertised outside the Orthodox Jewish community, lohud.com said.
The development's owners are demanding that the village back off, claiming that it is trampling on their First Amendment rights and the Religious Land Use and Institutionalized Persons Act, according to lohud.com.
The latter’s provisions are designed to protect individuals, houses of worship and other religious institutions from discrimination in zoning and landmarking laws, according to the U.S. Department of Justice.
