Nassau County District Attorney Anne Donnelly’s office announced on Thursday, April 14 that charges against Malcolm Griffin, who was allegedly involved in a near-fatal shooting, have been dropped due to an unreliable witness.
Griffin was arrested on Dec. 10, 2019, a spokesperson for the DA said, at which point he was charged with attempted murder and other related charges for a shooting incident in Roosevelt on Feb 17, 2016.
The victim, a cab driver, was shot in the face and suffered the loss of an eye, he said.
According to the spokesperson, the case was to be brought to trial in January 2022, but further investigation by the DA’s office found that a person who allegedly witnessed the incident was deemed to not be truthful.
The DA then brought that note to the attention of defense counsel, and the court, and sought to have Griffin released from jail.
“The NCDA commenced an extensive and thorough review – in conjunction with the Nassau County Police Department – of the case,” the spokesperson wrote in a statement.
"We re-interviewed witnesses and re-examined the evidence. It was determined that we are unable to sustain the burden of proof necessary at trial.”
Charges against Griffin are in the process of being dismissed. The investigation into the 2016 shooting is ongoing, the spokesperson said.
