Retrial Ordered In 2008 Garrison Homicide Case

GARRISON, N.Y. -- Anthony Grigoroff could be headed for a retrial in connection with the 2008 killing of a 49-year-old Garrison man after an appeals court took issue with the evidence presented at his trial nearly five years ago, according to a story on lohud.com.

The state Supreme Court's appellate division decreed Grigoroff be retried; he was 19 when he was sentenced to 25 years to life after being convicted of killing John Marcinak during a botched break-in on New Year's Eve, the lohud.com story said.

The court said several pieces of evidence during the trial prejudiced the jury, which found Grigoroff guilty in October 2010, the story said.

Grigoroff was convicted of second-degree murder, second-degree criminal possession of a weapon and two counts of attempted second-degree burglary, the story said.
