State Supreme Court Justice Paul Marx said Ray DiFrancesco's misdemeanor assault case should have been sealed immediately when the charges were withdrawn last year. DiFrancesco filed a civil action against Cold Spring Village Justice Thomas Costello after Costello's ruling that withdrawing charges doesn't necessarily end the case, lohud.com says.
But Marx said that withdrawing charges is essentially the same as dismissing them. He ordered that charges be sealed and fingerprints and mugshots be destroyed, reports lohud.com.
The initial charges were in connection to DeFrancesco's effort to break up a fight on New Year's Eve at the Cold Spring restaurant, says lohud.com.
