Troopers were contacted by a Good Samaritan who reported that there was a man driving a red Buick on I-84 who appeared to be drinking a beer while he was driving on Monday, June 6, police said. The suspect's vehicle was stopped and the driver of the vehicle, David D. McCarthy of Montgomery, was found to be intoxicated at the time of the traffic stop, police said.

McCarthy provided a breath sample that revealed a Blood Alcohol Content of .09 percent and was arraigned in the Town of Fishkill Justice Court. He was charged with driving while intoxicated, a Class E felony, due to a previous DWI related conviction within the preceding 10 years.

McCarthy was released on his own recognizance and directed to appear in the City of Beacon Court on June 15.
