Westchester County District Attorney Anthony Scarpino announced on Tuesday that Daniel Stern, 52, of City Island has been sentenced to between two and four years in prison after being convicted of a felony charge of third-degree grand larceny.
According to Scarpino, in September 2015, Stern told his victim that he was an attorney that could represent him during a real estate transaction, requesting a $40,000 cash down payment, which was paid at the victim’s house. Unbeknownst to Stern, he was under video surveillance during the entire illegal transaction.
Stern would steal approximately $31,000 from his victim that was used for his own personal use. Forsenic accounting determined that the victim withdrew $40,000 from the bank, but that was never deposited into any of Stern’s bank accounts. Stern returned $9,000 to the victim, “admitting to the original theft amount,” Scarpino said.
The New Rochelle Police department conducted the initial investigation and got an assist from the Westchester County District Attorney’s Office. He was ordered to pay $31,000 in restitution and has been remanded.
