Man Attending DWI Impact Panel In Hudson Valley Arrested For Being Drunk

A 51-year-old Hudson Valley man ordered to attend a victim impact panel for a previous DWI was denied entry and arrested for driving with a blood alcohol content at three times the legal limit.

David M. Kilmer of Fishkill was arrested around 7 p.m. Thursday driving a 2013 Chevy pickup after being stopped on Millholland Drive by Dutchess County Sheriff's deputies, said Capt. John Watterson.

Kilmer, who was attempting to attend a required victim impact panel for a Jan. 18 DWI arrest, was turned away from the group meeting due to being intoxicated and having a blood-alcohol content at three times the legal limit, Watterson said.

When attempting to enter the panel, Kilmer claimed he did not operate a vehicle before his attendance and was advised not to operate a vehicle and call for a ride home. But instead, he was observed leaving the parking lot a few minutes later in his truck, Watterson said.

Deputies were notified, and he was stopped and arrested for driving with a suspended and revoked driver's license, felony aggravated unlicensed operation of a vehicle, and aggravated DWI, police said.

The panel is a court-ordered program operated by Council on Addiction Prevention and Education of Dutchess County. The program is held at the Town of Fishkill Town Hall. Attendees are ordered to appear after being convicted of an alcohol or drug driving offenses. The program contains several volunteers whose lives have been impacted by serious or fatal crashes related to impaired driving incidents.

Kilmer was arraigned in Town of East Fishkill Court where he was remanded to the Dutchess County Jail in lieu of $2,000 cash bail or $4,000 bond. He is scheduled to appear in the Town of Fishkill Court on Feb. 7.
