Judge May Release Video, Audio in DJ Henry Case

WHITE PLAINS, N.Y. – A federal judge may decide Thursday whether to allow the public to see and hear audio, video and other evidence taken at the scene of the fatal shooting of Danroy "DJ" Henry.

Michael Sussman, the attorney for Henry’s family, is seeking to lift a confidentiality order placed on the record. Federal Judge George Yanthis will discuss the scope of the confidentiality order at the hearing at 2 p.m. in the U.S. District Court in White Plains. 

Henry’s mother, Angella Henry, urged local residents on Facebook late Tuesday night to attend the hearing. 

“If you're in the White Plains area on Thursday, please go to the courthouse and express your concern and interest in having all video and audio be made public. It's in the best interest of every human being!” Henry said in a Facebook post.

In October of 2010, Henry, a 20-year-old Pace Univeristy football player, was fatally shot by Pleasantville Police Officer Aaron Hess after an altercation that started in a Thornwood bar. After Hess was not indicted on criminal charges stemming from the incident in February, a confidentiality order was placed on the evidence, such as 911 recordings.

Sussman said Wednesday arguments will be made on both sides before the ruling will be made in the civil case.
