Maria Herbert, of Wallkill, claims to have been incapacitated by accident, suffering a case of post-traumatic stress disorder that has left her unable to work, according to the report.
Though a federal jury awarded her $835,000 for her injuries, she had previously entered into what the report calls a "high-low settlement" with the railroad.
The Dec. 1, 2013 crash in the Bronx killed four people and wounded dozens more.
