Nicholas Obrzut, 21, of Monroe Township, was charged on Wednesday, Apr. 3 with two counts of aggravated assault and three counts of assault by auto. Ocean County Prosecutor Bradley Billhimer announced the charges in a news release on Monday, Apr. 8.
Jackson Township police responded to the crash near the intersection of North County Line and Jackson Mills roads at around 2:15 p.m. on Saturday, Jan. 27. A 2020 BMW driven by Obrzut was heading west on North County Line Road when he failed to drive around a right curve and hit the curbed median.
Obrzut lost control of the BMW and the vehicle rolled through the intersection with Jackson Mills Road until it hit trees on the side of the road. Obrzut and all three of his passengers were injured in the crash.
The two rear passengers, a 22-year-old Monroe Township man and a 23-year-old Manalapan man, were brought to Jersey Shore University Medical Center (JSUMC) in Neptune. They were released from the hospital and are recovering from their injuries at home.
Another 21-year-old man from Monroe Township was Obrzut's front passenger. He was taken to CentraState Medical Center in Freehold with minor injuries.
Obrzut also had minor injuries and was treated at JSUMC. While at the hospital, a court authorized a warrant to have blood drawn from Obrzut.
Laboratory results showed Obrzut's blood had an active THC level of 14 nanograms and a metabolite THC level of 100 nanograms.
"It is reasonably certain that Obrzut’s faculties were impaired due to the effects of marijuana intoxication, and that he could not have safely operated a motor vehicle," Billhimer said.
Investigators also said Obrzut's BMW was traveling more than 100 miles per hour right before the crash in a 50-mph zone. There was also low visibility due to fog.
Obrzut was arrested at his home on Wednesday, Apr. 3, and released from the Ocean County Jail on bail.
