Rakesh J. Desai was arrested by prosecutor’s detectives after the New Jersey Office of Attorney Ethics tipped them off, Molinelli said.
The accident occurred in 2003, he said.
In October 2011, Molinelli said, Desai settled an insurance claim for $10,000 without consulting the victim, signed the person’s name to the back of the check and deposited it into a trust account.
Several days later, Desai withdrew the money through a cashier’s check and used the money for himself, the prosecutor said.
Desai was issued a summons to appear in Bergen County Central Municipal Court to answer charges of theft, misapplication of entrusted property and forgery.
