Boston Marathon Bombing Suspect Dzhokhar Tsarnaev Charged

FAIRFIELD COUNTY, Conn. – Federal authorities Monday charged Dzhokhar Tsarnaev, the surviving suspect in the Boston Marathon bombings one week ago, with using a “weapon of mass destruction,” but the 19-year-old will not be tried as an “enemy combatant.”

According to The Washington Post, Tsarnaev was “specifically charged with one count of using and conspiring to use a weapon of mass destruction (namely, an improvised explosive device or IED) against persons and property within the United States resulting in death, and one count of malicious destruction of property by means of an explosive device resulting in death.”

He will be tried in civilian court, despite several Republican legislators urging the White House and the Department of Justice to try him in military court as an enemy combatant. If convicted, Tsarnaev could face the death penalty, because he is facing a federal charge not a state charge. Massachusetts does not have the death penalty.
