The warrant, obtained by WFSB Eyewitness News 3, details the arrest of Erving Rivera, age 50, of Hartford, for allegedly kissing and having sexual contact with a female student in his classroom.

He was arrested and charged on Wednesday, April 5, with sexual assault and illegal sexual contact with a victim under 16, court records show.

Rivera, who was a special education teacher at Lincoln Elementary School in New Britain, was caught after another teacher saw him whisper in the student's ear and asked the student what he said.

Her reply: "What happens in my room, stays in my room."

According to the warrant, the child told the behavioral assistant that Rivera kissed her on her cheeks and lips and that he would put his hand under her shirt, touch her back, and tickle her and she said "she would wiggle until she fell to the ground" and he would touch the bottom of her pants.

Police and the Department of Children and Families were contacted and an investigation was conducted which led to Rivera's arrest.

According to WFSB, the district school Superintendent Tony Gasper also sent a letter to parents regarding the incident on Wednesday, April 5 that notified them of Rivera’s arrest.

He wrote that Rivera was removed from the school and placed on leave after the abuse came to light and as they waited for the investigation to be completed.

Rivera resigned from the district on Wednesday, March 22, Gasper said.

Following a court hearing on Thursday, April 6, Rivera was released on a $100,000 bond.

The former teacher will next appear in court on Thursday, April 20.
