FBI Director Declines To Call For Charges Against Clinton Over Server

FBI Director James Comey announced Tuesday that he will recommend to the U.S. Department of Justice not to bring criminal charges against former Secretary of State Hillary Clinton over her use of a private email server at her home in Chappaqua, N.Y., according to news reports.

Comey, at the televised press conference, argued that no reasonable prosecutor would bring charges forward in the case. 

The probe was into whether Clinton, the presumptive Democratic presidential nominee, mishandled classified information.

Comey, a longtime Westport resident, announced that some data was marked classified at the time that it was shared while some were later "up-classified" in status. 

Even if the data had not labeled as classified at the time it was shared, Comey added that Clinton should have known it to be as such.

While Clinton may not face a criminal indictment, Comey was scathing in his assessment calling her conduct "reckless."

The decision on whether to indict Clinton will formally be decided by Attorney General Loretta Lynch, who, according to published reports, expressed deference toward the FBI's recommendations after recently coming under criticism for briefly speaking with Clinton's husband, former President Bill Clinton, at an airport.
