The company, The O'Neill Group-Dutton, LLC, said the town board's denial of a zoning change to add another 84 rental apartments to the 300 that already received the go-ahead from the City of Poughkeepsie on property located on the city-town line, said the Journal.
The $73 million project, "One Dutchess Avenue," is the largest project underway in Dutchess County, the Journal added.
The lawsuit alleges the town board acted "arbitrarily and capriciously," and asks the court to rule against the town's vote, said the Poughkeepsie Journal.
The board counters that numerous issues, including open space, recreational facilities, density, parking and other items, were not addressed to their satisfaction, added the Poughkeepsie Journal.
