The autopsy report lists the official cause of death as drowning. Viafore was not wearing a life vest and capsized in hypothermic water. Toxicology reports also stated that Viafore had a blood alcohol concentration of .066, below the legal limit. Graswald's attorney's said the examiner overstepped his bounds by deeming Viafore's death a homicide, The Times reported.
Viafore went missing on April 19. His fiancée, Angelika Graswald, 35, of Poughkeepsie, contacted authorities saying she was unable to locate him after he capsized. Subsequent investigation prompted authorities to charge Graswald with murder. Viafore's body was recovered in the middle of the river on May 23.
