Putnam County District Attorney Robert Tendy announced that Lake Peekskill resident Anthony Grigoroff will serve the maximum term of between 25 years to life for the murder after being previously found guilty in 2010, though that conviction was overturned in 2015 before a second conviction came last month following a two-week trial.
Marcinak was shot and killed at his place of business, the Garrison Garage, when he interrupted a burglary on New Year's Eve in 2008, the district attorney said, adding Grigoroff was allegedly acting as a lookout and getaway driver.
“Let no one have any illusions that (Grigoroff) isn’t guilty,” Tendy said in a statement before the sentencing. “He gave great detail in his confession as to what occurred during the burglary and shooting, and that’s because he was there when it happened.
“No one could have had such knowledge of the crime scene and what occurred there unless he was personally present.”
Tendy noted that during his trial testimony, Grigoroff claimed that investigators with the Putnam County’s Sheriff’s Department forced him to confess.
“I find this reprehensible,” he said. “In fact, the exact opposite happened. The members of the Sheriff’s Department were very careful to do everything properly and took great pains to make sure the defendant’s rights were not violated.”
The DA went on to call Marcinak “a decent, caring, giving, loving father and friendly, decent, caring and giving member of his community.”
Gigoroff did not speak during sentencing before being remanded into the custody of New York State Department of Corrections.
