Man Caught With Heroin, Cocaine After Passing Out At Diner In Yorktown: Police

A 35-year-old Hudson Valley man faces drug charges after passing out on the stairs of a diner in Northern Westchester while in possession of heroin and crack cocaine, police said.

The man was found passed out on the steps of the Route 202 Diner in Yorktown, police said.

The arrest stemmed from an incident on Friday, July 7 around 6:30 p.m., when Yorktown Police responded to the Route 202 Diner at 3825 Crompond Rd. to help a man who had passed out on the stairs.

According to police, officers found out that the man, identified as 35-year-old Putnam County resident Eric Keith Miller of Lake Peekskill, was allegedly in possession of a quantity of crack cocaine and heroin. Miller was then arrested and charged with:

Fifth-degree criminal possession of a controlled substance, a felony;
Seventh-degree criminal possession of a controlled substance.

Miller was then arraigned in Yorktown Justice Court and remanded to Westchester County Jail in lieu of a $10,000 cash bond, $25,000 bond, or $50,000 partially secured bond. He will again appear in Yorktown Justice Court on Tuesday, July 11.
