Christian Koch, 40, of 104 S. Broadway, Yonkers, pleaded guilty April 23 to one count of second-degree perjury, a class E felony, the District Attorney's Office said.
On March 21, 2014, the defendant, a former Yonkers Police Department Narcotics Unit detective, and Neil Vera , 35, of 104 S. Broadway, Yonkers, swore falsely in an application for a search warrant for 141 School St., Apt. 3, Yonkers, the DA's Office said. During the raid, resident Dario Tena fell out a window nearly 40 feet to his death during a raid on March 21, 2014, according to police reports.
The false statement was made with intent to mislead a Yonkers City Court judge in the performance of his official functions signing the warrant, according to the DA's Office. The defendants surrendered to the Yonkers Police Department Internal Affairs Division, which assisted in the criminal investigation.
Vera previously pleaded guilty to one count of second-degree perjury and two counts of official misconduct, class A misdemeanors. Vera was sentenced on May 28 to six months of weekends in the Westchester County Jail, according to the DA's Office.
Assistant District Attorney Berit Huseby of the Public Integrity Bureau prosecuted the case.
