Steven D. Palmiotto, 40, owner and operator of the commercial refuse collection company TMI Industries, is charged with two misdemeanor violations of the environmental conservation law and allowing the release of solid wastes into the environment, according to a police report.
The Yonkers Police Department and the New York State Department of Environmental Conservation also issued several citations to Palmiotto, who allegedly left a large amount of compacted garbage in the Chicken Island parking lot, police said.
“Last night’s arrest is a message to any potential dumpers that there are consequences for your illegal actions and the City of Yonkers will not tolerate it,” Mayor Mike Spano said on Wednesday afternoon.
“Thank you to the swift investigation by the Yonkers Police, the County’s Solid Waste Commission and the DEC for identifying the person who exhibited complete disregard for the residents of our city. We will continue to work hard each day to make sure the quality of life of our residents is to the standard that this city deserves.”
The alleged dumping occurred at about 11 p.m. Dec. 28 and was captured on surveillance cameras, police said.
Palmiotto, who was arrested Tuesday, is scheduled to appear in Yonkers Criminal Court on Jan. 6.
“This should be a warning to all that if you dump in our city, we will thoroughly investigate,” Police Commissioner Charles Gardner said in a press release.
“In this case, the suspect not only faces criminal charges, but he also is faced with the possibility of large fines and seizure of his vehicle, which we are in the process of completing at this time.”
