Anthony Cruz, 30, of 70 Prospect St., Port Chester, left the bar and went to his car parked in the Chester Avenue lot at 12:10 a.m. Thursday, police said. He turned on his interior light and took out three zip lock bags with a substance they later determined to be MDMA, also known as ecstasy and put it in his pocket and returned to Black Bear, police said.
Cruz returned to his car around 1:56 a.m. with another person, later identified as David Ortiz, 25, 87 Inwood Ave., Port Chester, according to police. Police say both reached into the center console of the car and Cruz grabbed the same zip lock bags, which is when police made their move.
Police recovered four black-tinted zip lock bags with MDMA, which they say was packaged in a manner consistent with the sale of hallucinogenic substances. One clear plastic bag with marijuana was also found in the center console, police said.
Cruz told police the drugs were not his and that he never went in or out of the car and that a girl had his keys and was the one in and out of his car, according to police. Ortiz also said the drugs were not his.
Both suspects were charged with third- and fourth-degree possession of a controlled substance, felonies, and first-degree loitering, a misdemeanor. They were held for court.
