Acting Westchester County District Attorney James McCarty announced Friday that Rasheed Smalls, 35, was found guilty of individual charges of committing a criminal sexual act and official misconduct for assaulting a woman in a utility closet at one of the housing units he was tasked with protecting.
According to McCarty, on July 28 last year, while on duty at the Bedford Hills Correctional Facility, Smalls “entered a utility closet of one of the housing units with the victim and engaged in oral sexual conduct with her, for his own personal satisfaction.”
“The oral sexual conduct occurred at a time when the victim was incapable of consent by virtue of her being an inmate committed to the care and custody of the New York State Department of Corrections and Community Supervision,” McCarty stated.
During his time with the Department of Corrections and Community Supervision, Smalls had been trained on inappropriateness, illegality and avoiding personal relationships with inmates.
Smalls has been remanded to the Westchester County Jail. He is due to be sentenced on Wednesday, Aug. 10.
