The man, 36-year-old David Treacy, was convicted of promoting or possessing a sexual performance by a female under 17 years old in 2015 in the upstate town of Colonie near Albany.
The Division of Criminal Justice Services has assigned Treacy as a level two threat, which means he is at "moderate risk of a repeat offense."
The Route 202 resident has several conditions in regards to his supervision, including a curfew and mental health referrals. He also must maintain employment. In addition, he is not allowed to access a computer in his home, must complete counseling and cannot seek any pornographic materials. Treacey was also enrolled in an anti-aggression and polygraph program.
Treacy was arrested by the Westchester County Department of Public Safety in May 2014 and convicted in November 2015 by local police. He was sentenced to between one and three years in prison before being released and making his way to Somers. He will be under post-release supervision until January 2019.
