The defendant was driving a 2001 Lincoln Town car at a high rate of speed in the vicinity of 83 Rumsey Road in Yonkers when he lost control of the vehicle and crashed into a tree, splitting the car in half, on Oct. 19, 2014, at approximately 3:11 a.m., officials report.
His passenger, who was not wearing a seatbelt, was sitting in the front passenger seat of the vehicle at the time of the crash, and was killed instantly, officials report.
Simmons was taken to Jacobi Medical Center in the Bronx with non-life threatening injuries; subsequent toxicology tests revealed that the defendant was under the influence of PCP and marijuana at the time of the crash, according to officials.
McCarty reports that Simmons was found guilty of several charges, including: one count of vehicular manslaughter in the second degree, a class D felony; one count of criminally negligent homicide, a class E Felony; one count of operating a vehicle while ability impaired by drugs, a class E felony; one count of reckless driving, an unclassified misdemeanor; and one count of aggravated unlicensed operation of a motor vehicle in the third degree, an unclassified misdemeanor.
Simmons’ remand continues. He is due to be sentenced on Wednesday, April 20. The defendant faces a maximum of seven years in state prison.
Assistant District Attorney Heide Mason of the Superior Court Trial Division is prosecuting the case.
