Port Chester Man Drove Drunk With 3-Year-Old In Car, Police Say

PORT CHESTER, N.Y. -- A Port Chester man was charged with drunk driving under Leandra's Law after state police noticed him weaving from lane to lane.

Elio Ortega was charged with driving drunk with his 3-year-old daughter unsecured in the backseat of the car.

Elio E. Ortega, 30, was charged with aggravated DWI under Leandra’s Law, after troopers pulled him over on Stevers Crossing Road for failing to maintain his lane and use his turning signal. When troopers approached the car, they found Ortega's 3-year-old daughter unsecured in the backseat, police said.

A blood alcohol test revealed Ortega had a .08 percent level. He was remanded to the Columbia County Jail in lieu of $500 cash bail.

Leander's Law is named after Leandra Rosado, an 11-year-old girl, who was killed on the Henry Hudson Parkway in 2009 after her friend's mother, flipped the car they were in traveling in while allegedly under the influence of alcohol.
