PELHAM, N.Y. The debate about the status of Hillside and Brookside avenues as public or private streets reignited at the Village Board meeting Tuesday night.
Brookside Avenue resident Jamie Cabarrocas addressed the board during the public comment portion of the meeting because he received a notice from the nearby Clovelly complex, which said its administration would meet with the Village of Pelham Board of Trustees to reach an agreement about the streets.
Mayor Ed Hotchkiss said the board and the Clovelly representatives could not reach an agreement several months ago, but now they have come to an understanding that all homeowners on the streets will have a parking space. Hotchkiss added that Clovelly will essentially agree that it will not contest in court that the streets are public.
Cabarrocas has been vocal that Brookside Avenue is a private street and has opposed the potential expansion of the Pelham Picture House. He spoke to the board Tuesday night because the letter he received from Clovelly mentioned the theater.
Youve always maintained that the Picture House plans had nothing to do with whether its a public or private street, Cabarrocas said to Hotchkiss and the other board members in attendance.
Hotchkiss countered that the Pelham Picture House is not currently taking any action, and trustee Theresa Mohan said that all the board wants is the recognition that the street is public. Hotchkiss said there can be no confusion as to whether the street is public or private.
Cabarrocas questioned why other private streets, including Manning Circle, are not up for debate. He said if Hillside and Brookside avenues are in question, then the board should consider all private streets in the village.
Were not doing it selectively, but we cant do everything at once, Hotchkiss said.
Cabarrocas asked the board to make it clear to the Clovelly representatives that the Pelham Picture House contingency must not be involved in the agreement. The board tabled the issue several months ago, which made Cabarrocas wonder why the board and Clovelly were in talks. Hotchkiss replied that the two sides can talk to each other but the board cannot pass any resolutions without bringing them before the public.
