Westchester County District Attorney Anthony Scarpino Jr. said Tuesday that 32-year-old Juan Sumba Duchi was found guilty of felony counts of first-degree attempted rape, second-degree assault and third-degree assault, a misdemeanor, for an incident dating back to 2015.

According to Scarpino, at approximately 10 p.m. on Dec. 22, 2015, Duchi allegedly drove his ex-girlfriend to an isolated Fisher Avenue parking lot, where he demanded she have sex with him. When his ex-girlfriend refused, she “begged (Duchi) to take her home,” before he “became enraged and attacked her,” breaking her nose and then attempting to rape her in the car, Scarpino said.

Duchi’s ex-girlfriend was able to fight him off and escaped the vehicle, Scarpino said. Duchi then went after her again, kicking and punching her while she lay on the ground, breaking her collarbone by stomping on it. A passerby heard the struggle and called 911, while two others in the vicinity came to her aid and pulled Duchi off her.

Police arrived within minutes and Duchi was apprehended at the scene. His remand continues. He is due back in court on Tuesday, May 23, where he will face a maximum sentence of 15 years on the attempted rape conviction and seven years for the assault.
