Owner of Elmsford Frank's Cafe Charged With Felony

ELMSFORD, N.Y. — Frank Confalone, the owner of Frank’s Food Court restaurant, has been accused by the state’s department of taxation of not paying $260,000 in state and city sales taxes.

Confalone, who is the sole owner of F.M.C. Market Inc. and has been running the restaurant for 20 years, was charged with grand larceny, second and fourth-degree criminal tax fraud and offering a false instrument for filing, all felonies.

Sitting Friday morning in the office at the back of his restaurant on East Main Street, Confalone cried and said he couldn't explain the charges. He said the restaurant had gotten very busy.

"It just got out of hand,” he said. “I really, to this day, still don’t know what happened.”

Confalone said he doesn’t want anybody else in his organization to be affected.

“I took the blame for everything. It’s all me. I don’t care,” he said. "I am paying the bill. That’s it."

Confalone said he’s doing everything the state is asking him to do and that he will pay the $260,000.

He said he was embarrassed by the charges and refused to take a picture.

“I don't want my kids to see me like this,” Confalone said, weeping.

Confalone was arraigned Wednesday in Elmsford.

Doug Friedle, Elmsford court clerk, said the case should be moved to the county court at White Plains since village courts don’t prosecute felonies.
