A 38-year-old man is facing a series of charges after receiving his second DWI conviction in 10 years following a state police investigation into a crash on I-84 in Putnam County while he had two children in the back seat not wearing seatbelts.

New York State Police troopers launched an investigation into a motor vehicle crash on I-84 at approximately 7 p.m. on April 14 in Kent.

Troopers said that the investigation determined that Bronx resident Joey Rivera was under the influence of alcohol, driving the vehicle without the owner’s consent. He also had a previous DWI conviction and two backseat passengers under the age of 16 who were unrestrained.

It was further determined that Rivera was allegedly in possession of a stolen Electronic Benefits Card and had previously used it to purchase items before the crash.

Following the investigation, Rivera was arrested and charged with felony counts of driving while intoxicated with a previous conviction within 10 years, aggravated driving while intoxicated with a child less than 16 and aggravated unlicensed operation of a motor vehicle.

Rivera was also charged with operating a motor vehicle without an Interlock Device, unauthorized use of a vehicle, endangering the welfare of a child, reckless endangerment, unlawful possession of personal identification information, petit larceny and reckless driving, all misdemeanors.

Following his arrest, the two children were transported to a local hospital and released to family shortly thereafter. Rivera was arraigned in the Town of Kent Court and remanded to the Putnam County Jail in lieu of $15,000 cash bail or $30,000 bond. He is due back in court on May 7 to answer the charges.
