Cortlandt Man Faces Four Felony Drug Charges

PUTNAM, N.Y. – A Cortlandt man was charged with four drug-related felonies and one misdemeanor, after Putnam County Sheriff’s Office said he sold an undercover officer oxymorphine pain pills, and officers found oxymorphine stashed in a household cleaning bottle in the man’s car. 

Deputies say in June of 2011 John Magner, 32, of 101 Dogwood Road, was observed selling prescription pain medication in the Continental Village area of the Town of Philipstown. Police say that members of the Putnam County Sheriff’s Narcotics Enforcement Unit were able to purchase oxymorphine from Magner on two occasions.

On Jan. 20, 2012, narcotics deputies say they observed Magner in his 2001 Buick and took him into custody, charging him with four felonies and one misdemeanor. Magner was charged with two felony counts of criminal possession of a controlled substance, two felony counts of criminal sale of a controlled substance, and one charge of criminal possession of a controlled substance. 

Magner was arraigned before Putnam Valley Town Justice Louis DiCarlo and remanded to the Putnam County Correctional Facility in lieu of $50,000 cash bail. Magner was later released after posting the required bail. 

Narcotics officers also seized Magner’s 2001 Buick. It is being held pending asset forfeiture proceedings.

If convicted of any count of the felony charge he is facing, authorities say Magner may be sentenced to a term of incarceration for up to nine years in a New York State correctional facility as determined by a court.
