Astorino's attorney filed paperwork to discontinue the lawsuits Thursday, according to LoHud. Astorino was defeated by Senator George Latimer last week in his bid for a third term.
Indian Point is set to close in 2020 and 2021 after Entergy, which owns Indian Point said it was closing down the plant because it was no longer economically viable to remain open.
Astorino launched his suit in May, saying the agreement between the state, Entergy, and Riverkeeper, which had been suing the plant, violated the state's Environmental Quality Review Act. Astorino was hoping to invalidate the agreement until a review is conducted.
Astorino was filing the lawsuit on his own behalf at no cost to the county.
