Suspect In Nyack Shooting Faces Assault, Weapons Charges

CLARKSTOWN, N.Y. -- Clarkstown police have charged a Rockland man with assault in connection with a shooting in Nyack.

Police said they had been searching for Darique Burke, 20, of the Nyack area, since the March incident in which another 20-year-old man was wounded on Upper Depew Avenue in the village.

The man was walking near the Super 8 hotel around 5:40 p.m. on March 12, when he suffered the non-life-threatening injury to his mouth.

Burke, who goes by the nickname of “Rico,” was arrested on Thursday, April 7, and charged with second-degree assault, a felony; and criminal possession of a weapon, a misdemeanor, police said.

Police said it appears that Burke did not intentionally shoot the victim, but was handling a gun that accidentally went off.

The investigation so far has not turned up any signs of a dispute between the two men, police said.

The gun itself has not been recovered, police said.

Burke was arraigned at Clarkstown Justice Court and was sent to Rockland County Jail in lieu of $50,000 bail, police said.
