The 23 residents filed a petition Tuesday night before the Town of New Castle could host a public hearing on the proposed Chappaqua Crossing retail plan that would add a supermarket and retail space to the former Reader's Digest property, town representatives confirmed. The petition follows town law 265, which allows neighbors to sign a petition to "basically force a supermajority vote" on a decision, town representatives said.
The signers of the petition oppose Summit/Greenfield’s plan to add a 36,000-60,000 square-foot supermarket and several other stores to the Chappaqua Crossing area. Summit/Greenfield is seeking a zoning change to the area and with the petition, must obtain a supermajority from the town board before the process could continue.
With five voting members of the board, the petition would up the requirement of aye votes to four instead of the typical majority of three needed to approve zoning changes, town representatives said. But the petition will actually force the board to obtain a 4-0 decision as Council member Elise Kessler Mottel previously recused herself from voting on Chappaqua Crossing.
The public hearing that was set for Tuesday was adjourned to Sept. 3 to allow Summit/Greenfield to submit a storm water study.
