Bedford resident Marie Monteleone has been arraigned on a felony charge of second-degree grand larceny following a two-year investigation into the misappropriated funds, Westchester County District Attorney Anthony Scarpino, Jr. announced on Thursday.
According to Scarpino, Monteleone’s son was born with severe birth effects, prompting his parents to file a lawsuit that resulted in a settlement that was to be used for his benefit alone.
However, over the course of several decades, the victim - who is now 41 years old - received Social Security benefits, but was never told by Monteleone that he also had a second source of money to support himself and pay for college, Scarpino noted.
In total, Monteleone stole approximately $130,000 from the settlement, using the money to pay for her own personal expenses without the consent or knowledge of her son.
Monteleone was arraigned in Westchester County Court and pleaded not guilty to the charge. She was released on her own recognizance and is due back in court on Oct. 11, when she will face a maximum of five to 15 years in prison.
