Municipalities were required to file plans for providing for low- and moderate-income housing under the Fair Housing Act. by Dec. 8 in order to seek relief from Builder's Remedy lawsuits, according to northjersey.com.
Rutherford, like other towns, had previously filed plans in 2008 with the Council on Affordable Housing (COAH), the previous state enforcement agency, who hadn’t yet certified any plans, reports northjersey.com.
COAH’s authority is now in the hands the courts and Rutherford and 70 other municipalities, filed a judgment that their housing elements and fair share plans satisfy their constitutional obligation, according to northjersey.com.
