Changes In Affordable Housing Laws Force Rutherford To Revise Plans

RUTHERFORD, N.J. — State affordable housing mandates are being revised and Rutherford submitted a plan earlier last month stating its obligation is already met, reports northjersey.com.

Municipalities were required to file plans for providing for low- and moderate-income housing under the Fair Housing Act. by Dec. 8 in order to seek relief from Builder's Remedy lawsuits, according to northjersey.com.

Rutherford, like other towns, had previously filed plans in 2008 with the Council on Affordable Housing (COAH), the previous state enforcement agency, who hadn’t yet certified any plans, reports northjersey.com.

COAH’s authority is now in the hands the courts and Rutherford and 70 other municipalities, filed a judgment that their housing elements and fair share plans satisfy their constitutional obligation, according to northjersey.com.
