Adam Niemira, 27, was arrested yesterday after the 26-year-old woman went to police, Bergen County Prosecutor John L. Molinelli said this afternoon.
The victim told them she awoke at Niemira’s second-floor Woods Street apartment to find him “engaging her in sexual intercourse,” Molinelli said.
“The victim struggled briefly…before leaving the residence and returning home,” he said.
She called Garfield police, who notified Molinelli’s Special Victims Unit. Together they interviewed the woman, who the prosecutor said “provided details of what had occurred and stated that she had not consented to engaging in any type of sexual activity” with Niemara.
Niemira, who is single and unemployed, was being held on $150,000 bail in the Bergen County Jail, charged with aggravated sexual assault. An arraignment was scheduled for this coming Wednesday.
