Justin Kinney, 26, was indicted by a federal grand jury in Newark on two counts of producing child pornography, U.S. Attorney Paul J. Fishman said.
Kinney was previously arrested and charged by federal complaint last April and was being held in a state prison on related charges.
According to the indictment, other documents filed in this case and statements made in court, Fishman said:
“On Oct. 25, 2012, law enforcement officers executed a search warrant on Kinney’s laptop computer and cell phone, which revealed several files depicting child sexual abuse, which appeared to be self-produced and were taken with the same type of cell phone seized from Kinney at the time of his arrest.”
Each count of production of child pornography carries a mandatory minimum penalty of 15 years in federal prison — and up to 30 years, under federal guidelines.
Fishman credited special agents of Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI) Newark Division and the Essex County Prosecutor’s Office. Handling the case for the government are Assistant U.S. Attorneys Danielle M. Corcione and Danielle Alfonzo Walsman of Fishman’s Criminal Division in Newark.
