Matthew Hazuda (above, left) and Rahul Mathew (right) have remained free since a judge approved prosecutors’ request in October to waive the case to adult criminal court.

Detectives arrested Hazuda, who was 16, and Mathew, who was 17, after the girl, then 14, told her mother in October 2011 that she’d been attacked two months earlier.

She gave investigators a “detailed account “ of being “forcibly engaged in inappropriate sexual activity…while she was highly intoxicated and unable to consent to such activity,” , Bergen County Prosecutor John L. Molinelli said last fall.

Hazuda was taken into custody first, on Nov. 29, 2011, and Mathew on on Dec. 9. Both were released to the custody of their respective parents, Molinelli said. They also were ordered not to have contact with the girl.

The five-count indictment returned by a grand jury in Hackensack also includes a charge of impairing the morals of a minor.
