Three Hackensack men take plea deals in statutory rape of girl, 15

EXCLUSIVE: Three Hackensack men accused of statutorily raping a 15-year-old girl and videotaping the acts have taken plea deals that will bring one of them three years in prison, another a possible year in the county jail and the third probation.

A fourth defendant has rejected a deal and appears headed to trial early next year.

All four were originally charged with various assaults from June 7-9 last year — four months shy of the girl’s 16th birthday. The statutory rape laws under which they were charged protect youngsters between 13 and 16, and require penalties for offenders at least four years older than their victims.

All three were in Superior Court in Hackensack on Monday:

Justin Elliott, 40, of Polifly Road (above, left), pleaded guilty to second-degree sexual assault in exchange for a flat three-year sentence in state prison without parole. He remains free on $75,000 bail pending sentencing for all three on Jan. 24;

Anthony Duane Spray, 45, of Mary Street (above right), pleaded guilty to fourth-degree criminal sexual contact and may be sentenced to 364 days in the Bergen County Jail, which Assistant Bergen County Prosecutor Dion Findley said he will request. Spray is expected to ask the judge for probation;

Steven Conti, 25, also of Mary Street (above, middle), pleaded guilty to fourth-degree criminal sexual contact and will be sentenced to time served and probation. He was released on his own recognizance.

All three must register as Megan’s Law offenders and will remain on parole supervision for life.

A fourth man, Nicholas “Troy” Jackson, 36, appears headed to trial if he doesn’t accept a plea agreement.

He is charged with two second-degree counts of sexual assault and debauching or impairing the morals of a minor.

Elliott was originally charged with two-second degree counts of sexual assault, debauching or impairing the morals of a minor, and photographing or filming the girl in sexual penetration.

Conti was originally charged with three second-degree crimes: sexual assault, criminal sexual contact, and photographing or filming the teen involved in sexual intercourse.

Spray was charged with fourth-degree criminal sexual contact and with filming or photographing the girl engaged in intercourse and in fellatio.
