Rockland contractor cleared in Mahwah home-building case

UPDATE: A Rockland County contractor successfully completed pre-trial intervention after Bergen County authorities charged him with taking $200,000 for a new home in Mahwah that he never built.

A Superior Court judge in Hackensack granted a request by the Bergen County Prosecutor’s Office for early termination of pre-trial intervention and the dismissal of the charges against Samuel Diaz of Suffern.

The judge’s order noted that the victims “have been made whole via full restitution in the amount of $211,500.”

For his part, Diaz told CLIFFVIEW PILOT:

“[I]t is true that I did sign a contract and take a deposit to build a home in Mahwah, NJ. However…I took a deposit to build a home on property that my company does own and has possession of.

“The problem I faced with respect to building the home was that the financing I had in place fell through and while seeking financing elsewhere, the contract expired and the buyer pulled out of the transaction.

“My attorney was in constant contact with the buyer’s attorney. There was never any intent to steal, defraud or misrepresent in any way.”
