Paterson man who sexually assaulted River Vale boy, 4, will be sent to treatment center

EXCLUSIVE REPORT: A judge in Hackensack yesterday handed down a 10-year sentence to a Paterson man who used his friendship with a River Vale family to sexually assault a 4-year old boy.

Jason Martini, 29, will begin his sentence in state prison and will then be transferred to the Adult Diagnostic and Treatment Center at Avenel once a bed becomes available, based on an evaluation that deemed him a repetitive and compulsive offender, Superior Court Judge James J. Guida said.

Although he pleaded guilty to a lesser crime in exchange for the sentence, Martini admitted that he made the boy give him oral sex.

Given the opportunity to speak on his behalf, he declined.

The child, now 7, “is in therapy every week,” the heartbroken mother told the judge.

“My poor little boy was only 4 years old at the time,” she said. “I had to stop working a very good job so I don’t have to leave him with anyone.”

Defense attorney Harley Breite called it “a very sad case.”

“My client is a good person,” she said. “After doing the wrong thing, he fought off his urges and did the right thing. No one caught him. He took himself out of the situation.”

The mother said that wasn’t true.

“He continued to pretend he was my friend for more than a year” after assaulting her son, she told the judge.

“I do not see any remorse in his actions, or that anything was offset,” she said. “Since this has happened, I am now aware that evil exists.”

Once he’s transferred to Avenel, Martini could remain civilly committed indefinitely if he’s determined to be a danger.

If released, he’ll remain on lifetime parole supervision, Megan’s Law sex offender registration requirements and Nicole’s Law stipulations that he have no contact with the victim or the boy’s family for life.

Guida told Martini that he could also be required to wear a monitoring bracelet for life if he’s released.

Martini was working as a pizza deliveryman when he was arrested last August afer the boy told a family member of the 2012 and 2013 assaults.
