Charles Start went to the state’s highest court after an Appellate Division panel in May supported a finding by a Superior Court judge in Hackensack that there was no reason for his complaint to continue.

The incident began with a 911 call from Stark’s wife of an argument. She also made a subsequent hour-long call to a Cliffside Park officer – described as a close personal friend – in which she described being assaulted, authorities said.

After suspending him without pay in February 2010, the Borough Council unanimously agreed to fire Stark a year and a half later following the administrative review, which took several months.

The hearing officer, former Superior Court Judge Robert Guida, found that Stark assaulted his wife, conducted an extramarital affair while working and neglected his duties. The officer also accused the 10-year veteran of lying.
