Calculations showed that Frederick Orsini received a harsher sentence in May than he agreed to under a plea bargain.
So he was brought back before Presiding Superior Court Judge Liliana DeAvila-Silebi, who cut the sentence to 10 years that Orsini, 37, must serve once he completes the time he’s now spending for another conviction at East Jersey State Prison in Rahway.
DeAvila-Silebi originally sentenced him to 16 years, two of which would be included in the remaining time he has left to serve on an 8-year state prison term before he is eligible for parole.
That would have left Orsini behind bars for another 13½ years after the current term ends before he’d have had a shot at parole.
Despite the adjustment, the conviction and sentence could still hurt Orsini when the time comes for the state Parole Board to consider his current sentence.
“There are no free crimes,” said Assistant Bergen County Prosecutor Deepa Jacobs, adding that parole eligibility “very much depends on his individual circumstances at the time.”
Taking a plea deal from prosecutors, Orsini admitted in May that he robbed a man in Rochelle Park of his wallet using a fake gun, then sprayed him with mace and took a cab to Paterson to buy heroin.
The June 2010 holdup was Orsini’s second offense in a month: He also maced a gas station attendant three days later, records show.
DeAvila-Silebi called Orsini’s rap sheet “one of the longest I’ve seen.”
She also warned him not to come before her again on a probation violation or she’d put him away for any time he hadn’t served.
