Judge Roy F. McGeady, sitting in Hackensack, found no probable cause for the complaint filed by Charles Stark to continue.
That puts Stark on the losing end of yet another court decision.
Stark filed the complaint in August, a week after a judge upheld his firing for having an extramarital affair while on duty and being involved in an alleged domestic dispute.
Stark accused Ramos of filing a false police report, perjury and false swearing in connection with an incident in which the chief said Stark turned in his duty weapon by pointing it at him while unloading it.
Another Superior Court judge ruled in July that Palisades Park authorities acted properly in sacking Stark, finding that he violated departmental rules and regulations.
The incident began with a 911 call from Stark’s wife, Mary, of an argument. She also made a subsequent hour-long call to a Cliffside Park officer – described as a close personal friend – in which she described being assaulted.
After suspending him without pay in February 2010, the Borough Council unanimously agreed to fire Stark last September following the administrative review, which took several months.
The hearing officer, former Superior Court Judge Robert Guida, found that Stark assaulted his wife, conducted an extramarital affair while working and neglected his duties. The officer also accused Stark of lying.
Stark received several commendations during his 10 years with the department. He also has had restraining orders taken out against him by other women and had weapons seized by authorities as a result of domestic disputes.
