Sgt. Lance Kelly and Officer Sean Bannon pulled the vehicle over around 9:30 last night while working a “Drive Sober or Get Pulled Over” detail, Capt. Robert Kaiser told CLIFFVIEW PILOT.

Leon Berry Jr. 43, of Wilkes Barre, was unable to produce any paperwork for the vehicle — and gave the officers a glimpse of the drugs while looking for it, Kaiser said. He also threw several bags of heroin out the window of the car, the captain said.

As they tried taking him into custody, Berry “attacked the officers by kicking them in the chest and striking one of the officers in the face,” the captain said.

So they sprayed Berry and took him into custody, he said.

He was being held on $40,000 bail, charged with two counts of aggravated assault on police, in addition to resisting arrest, heroin possession with the intent to distribute the drug and destroying evidence
