U.S. Border Patrol agents captured 34-year-old Abraham A. Chumil near Rio Grande City in Texas at the Mexican border, Breitbart.com reported this morning.
A judge in Hackensack sentenced Chumil in November to four years and three months without parole minus 446 days he’d spend in the Bergen County Jail since his Aug. 27, 2013 arrest.
A week after the sentencing, INS agents took him into custody for deporation, records show. He submitted a DNA sample for the national registry.
During a guilty plea last June to a single second-degree count of sexually assaulting a minor, Chumil said he was in his underwear during a sleepover at the children’s parents’ home when he became aroused as the girl sat on his lap while playing a cellphone game.
After she slid off, he said, he pulled her back, touching her buttocks and vagina. The girl’s 6-year-old sister was in the room at the time, prosecutors said.
In exchange for the plea, prosecutors dropped charges that included sexual contact, impairing or debauching the morals of a child and child endangerment through sexual conduct.
Authorities in Bergen County were determining how to handle the case while federal authorities proceed with re-entry charges.
